AFFIDAVIT OF SGT. COLIN SAWRENKO


 

IN SUPPORT OF AN APPLICATION FOR

FORFEITURE OF FIREARM

PURSUANT TO S. 117.03(3) C.C.


I, Colin Sawrenko, of the Town of Biggar, in the Provicne of Saskatchewan, hereby make oath and say:

  1. I am a Sergeant with the Royal Canadian Mounted Police and the commanding officer of the Biggar RCMP Detachment.
  2. I asssumed command of Biggar RCMP August 15, 2012.
  3. On April 12, 2013 I was informed by detachment support staff that there was matter that required my review.
  4. Biggar RCMP occurrence number 2003-0980 had a firearm exhibit on file pertaining to a protest against the Firearms Act.
  5. The said protest occurred in Biggar RCMP jurisdiction September 13, 2003.
  6. According to my review of the file, Edward HUDSON {hereinafter 'Mr. Hudson'} was in possession of a 12 gauge Cooey Model 84 shotgun, serial number 39346, at the protest, located at Argo Bush, public land located on Argo Road, 8 kms south of Biggar off of #4 highway.
  7. Investigation by police on scene revealed Mr. HUDSON did not possess a firearm licence.
  8. The above noted shotgun was seized on September 13, 2003. No charges were subsequently pursued.
  9. Previous commanders have contacted Mr. HUDSON over the years in attempts to have him obtain a licence to lawfully possess it or sign relinquishment of claim so it can be destroyed. These enquiries have been to no avail.
  10. I have conducted inquiries through the Canadian Firearms Registry Online (CFRO) which revealed Mr. HUDSON does not possess a firearms licence.
  11. On April 26, 2013 I contacted Mr. HUDSON by phone and spoke with him. I brought the issue to his attention. Our conversation revealed that he is not willing to turn the firearm over to anyone who may lawfully possess it. He advised that he will not retrieve the firearm from the RCMP it until "Steven Harper makes good on his promise" which I infer alludes to getting rid of the licensing regulations.
  12. Mr. HUDSON's above noted shotgun has been in RCMP possession since September 2003. Mr. HUDSON has not taken necessary steps to lawfully possess it nor have someone assume possession of it.

Take notice that an application will be made to the presiding Judge in the Provincial Court sitting at Biggar, Saskatchewan, on the 7th day of August, 2013 at ten o'clock in the forenoon, that the firearm, being a shotgun with serial number 39346, seized from you on 13th day of September, A.D. 2003, be forfeited to Her Majesty pursuant to Section 117.03 of the Criminal Code to be disposed of or otherwise dealt with as an agent of the Attorney General of Saskatchewan directs.

You will be afforded an opportunity to establish that you are lawfully entitled to possess the firearms pursuant to section 117.03 of the Criminal Code.
